Live to Fight Another Day: Issue Preservation for Trial Lawyers

CLE Credits:
*CT: 1.0 CLE Credits
  NY: 0.0 CLE Credits

Speakers:

Attorney Linda L. Morkan, of Robinson & Cole, LLP

Attorney Karen L. Dowd, of Horton, Dowd, Bartschi & Levesque, P.C.

Program Description:

Why should trial lawyers be thinking about an appeal while trying to win their case?  Because, while lawyers often argue whether the brief or oral argument matters most for a winning appeal, the truth is…it’s neither. The most important part of an appeal is the record.

Two veteran appellate attorneys will guide you through the murky waters of issue preservation at and before trial, and teach you how to ensure that you have an adequate record for appeal. From affirmative motions to objections at trial, there are many traps for the unwary and failing to seize the right moment can doom your future appeal. Come listen to their tips on how to keep things from going sideways.
