Construction disputes usually involve contested technical issues, seasoned and entrenched commercial parties, and zealous legal advocates. These are not the preferred ingredients for an “easy” resolution by mediation. Nonetheless, many construction disputes do eventually get resolved through the mediation process. The panel will “re-enact” several typical scenarios to illustrate the more difficult, recurring aspects of mediating construction disputes, with suggestions on how the participants can maximize the success of the mediation process.
