Presentation by Peter Benner on CLT article: Solving the Med Mal Riddle Through Co-Mediation

Innovation in dispute resolution will not happen without creating ideas to address the interests of potential users and circulating those ideas for discussion. In December 2015, Peter Benner and Dr. Michael Giordano published an article in the Connecticut Law Tribune on co-mediation by a physician and a process-oriented, interest-based mediator for resolving medical malpractice claims early in the dispute. This approach could be an attractive alternative to protracted litigation in significant and complex malpractice cases, either to agree on fair compensation based on the medical record or to weed out claims without sufficient merit. A copy of the article is attached. Peter and Mike will present this concept in further detail at the meeting for feedback and discussion among attendees.
