About the Program

The “American Rule” that each party is responsible for its own attorney’s fees has narrowed, as grounds for recovering attorney’s fees can be found in statute, common law and contract. Recovery of attorney’s fees is an issue in virtually every lawsuit, and is frequently the most significant issue. Litigators must not approach attorney’s fees claims as an afterthought to the underlying claims, but rather must from the outset of the case formulate their strategy for obtaining, or defending against, a fee award and work diligently to implement that strategy at every step of the case. In addition to providing nuts-and-bolts law and procedure on recovery of attorney’s fees in Connecticut, the program will offer practice “dos” and “don’ts” from the perspective of experienced litigators and the bench.

You Will Learn

  • The principal legal doctrines for recovering attorney’s fees in civil litigation
  • The procedural rules that apply to claims for attorney’s fees in Connecticut state and federal courts
  • Practical tips for prosecuting attorney’s fees claims and defending against such claims
  • Views from the bench on what makes for a good attorney’s fees claim presentation
