Program Description
The speakers will address how, when and why to use a vocational expert on contested insurance damages claims on issues related to employability, wage earning capacity, and job search mitigation. The speakers will discuss the standard methodology utilized in the field; and the difference between an Employability Evaluation v. a Functional Capacity Evaluation, which can be confused in the legal community. Often times cases involve two vocational experts and the speakers will discuss how to evaluate a vocational expert report and how to compare the two reports. In the early stages of a case, an attorney may not be thinking of retaining a vocational expert and when the plaintiff is deposed, relevant background information may be overlooked. The speakers will discuss the types of questions that are beneficial to vocational experts especially if the plaintiff is not available for an in-person vocational examination.
