Program Description:
Estate planning does not stop when a client passes away. In fact, many difficult issues only come to light when an individual dies. Post-mortem federal tax planning often presents significant challenges for fiduciaries and estate planning counsel. This presentation will cover many federal tax issues that an attorney representing an estate's fiduciary will face. Topics will include protecting a fiduciary from personal liability under the federal priority statute, new estate tax closing letter procedures, addressing liquidity issues to pay estate taxes without late payment penalty including recent changes to Graegin loans, income tax elections, estate tax elections, developments regarding the basis consistency rules, a new case on Section 2054, federal reimbursement provisions, and GST allocations.

James I. Dougherty is an attorney in the Estate and Trust Administration Department of Withers Bergman LLP, admitted to practice law in Connecticut and New York.  He graduated from Carnegie Mellon University, Phi Beta Kappa, with University and College Honors. He earned his law degree from William & Mary Law School. He assists executors and beneficiaries alike through all aspects of the estate administration process including probate, contested estates, contentious trust litigation, tax, and post-mortem estate planning issues. His practice also includes working with affluent individuals in the development and implementation of sophisticated planning techniques to help them accumulate, preserve, and transfer their wealth. James is a frequent author and speaker, nationally and internationally, on estate, trust, tax, and probate matters. He is a member of the Executive Committee for the Estates & Probate Section of the Connecticut Bar Association. James has been named as a Trusts & Estates Fellow for the Real Property, Trust & Estate Law Section of the American Bar Association for 2016-2018

Marissa Dungey is a Partner at Withers Bergman LLP based in its Greenwich, Connecticut office. She focuses on transfer tax planning, estate planning, and trust structuring for high net worth individuals and their families. Ms. Dungey is a frequent author and speaker on a variety of topics in the trusts and estates field, including transfer taxes, income taxation of trusts, trust administration, charitable planning, intra-family loans, planning with fund interests in the context of Chapter 14, and buy-sell agreements.  She earned her B.A. degree, cum laude, from New York University and her J.D. degree, magna cum laude, from Boston College Law School. Ms. Dungey is admitted to practice in Connecticut and New York. She is a member of the Connecticut Bar Association (CBA), Greenwich Bar Association, New York State Bar Association and American Bar Association (ABA).  She serves on the Executive Committee of the Estates & Probate Section of the CBA and the Vice-Chair of the Committee on the Non-Tax Issues Affecting the Planning and Administration of Trusts and Estates for the Real Property, Trust and Estate Law Section (RPTE) of the ABA.  Ms. Dungey was named as a Trusts & Estates Fellow for RPTE in 2014 and is currently an ACTEC Young Leader in RPTE
