G2 An ADR Professional’s Guide: Health Care Industry Cultural Differences and Regulatory ADR Framework

Effective January 1, 2009, the Joint Commission on Accreditation of Healthcare Organizations mandated that hospitals develop conflict management programs as a "pre-arbitration dispute resolution process" that will promote patient safety and quality by the implementation of an informal conflict avoidance systemic process. The panelists will examine the regulatory legal framework and the inherent educational and hierarchical differences that create the pressures and the recurring categories of complex hospital controversies, and will also deal with the behavioral factors that should be accounted for in the development of an effective interpersonal conflict management program.

J2 Tax Planning Techniques Using Grantor Trusts

A discussion of grantor trusts, including dealing with the basics of how to make a trust a grantor trust and more advanced subjects such as the new IRS rule on Section 675 reacquisition powers, the intersection of grantor trust rules with Subchapter S qualification (and in particular, what happens to S status when the grantor of a trust holding S corporation shares dies), how to set up a disregarded entity with multiple grantor trusts as members, and the sale of assets to an irrevocable grantor trust technique. The panel will also discuss the new 2009 tax legislation.
