LAWYER-TO-LAWYER DISPUTE RESOLUTION PROGRAM
Managed by the Public Service Department, this program provides speedy and
cost-effective closure to a variety of complaints between attorneys.
This dispute resolution program is the sole responsibility of the CBA’s Committee
on Lawyer-to-Lawyer Dispute Resolution. A nearly 100% success rate attests
to the program’s efficacy and attorney satisfaction with the resolution
process.
The range of lawyer-to-lawyer disputes handled by the program include the
splitting of fees, law firm dissolution and withdrawal of a partner or
shareholder from a law firm.
Attorneys may choose either mediation or arbitration. They may also choose to
mediate first, and arbitrate any issues left unresolved through mediation. In
the overwhelming majority of cases, mediation alone brings the parties together,
even when said parties have been unable to resolve things themselves!
As the CBA is without statutory jurisdiction, the program requires that all
parties voluntarily agree to be bound by the Program Rules before their dispute
is heard.
All parties are actively involved in selecting the mediator or arbitrator of
their choice, from among a panel of 41 members.
The current cost of the program includes an administrative fee plus $300 per
participant.
