Employee (Mis)classification: Independent Contractors and
Joint Employment Issues Facing Franchise Owners and Start Up Businesses

State and federal agencies have recently place great attention on the so-called “fractured workforce” and have increasingly challenged worker arrangements that fall outside the traditional employer-employee framework. While the high-profile targets of recent enforcement action are companies like Uber (for use of independent contractors) and McDonalds (regarding claims of joint employment with their franchised operations), the legal principles and enforcement objectives apply equally to smaller businesses. A large proportion of workers classified as Independent Contractors are found to actually be employees, resulting in significant unplanned liability for taxes, unemployment benefits, overtime pay and other employee benefits. This program will summarize the traps to which unwary business owners are subject and provide strategies to best advise clients contemplating non-traditional arrangements with their workers.
