Workplace Track
Presented by the Labor and Employment Law Section
About the Program
Three interrelated trends are leading to cognitive decline becoming a workplace concern: (1) The American population is aging; as people age they are more likely to develop dementia; (2) many older individuals are postponing retirement and working longer, and (3) cognitive testing and other diagnostic devices have developed which enable clinicians to detect dementia or indicators that dementia may develop. This program will examine those trends and the increase in employers and insurers utilizing those diagnostic tools in their workplaces.
You Will Learn
• About potential issues raised by cognitive testing under the Age Discrimination in Employment Act, The Americans with Disabilities Act, the Connecticut Fair Employment Practices Act and ERISA
• About the leading case in the U.S. involving cognitive testing, which is pending in the U.S. District Court in CT, in EEOC v. Yale New Haven Hospital
• About the diagnostic tools available and their accuracy
• About the prevalence of cognitive decline for individuals over 65
