About the Program:
Arbitration purports
to be “faster” and “more efficient” than litigation in resolving disputes. The
program will discuss techniques that counsel and the arbitrator can consider
that will help fulfill that promise.
You will Learn:
- What are you giving up
by arbitrating and why make that decision?
- Everything begins with
the arbitration clause. What provisions will facilitate a later
arbitration?
- The formal rules of
evidence do not apply in an arbitration. What opportunities does
this flexibility provide for reducing costs.
- What procedural
devices might the parties consider in order to make the hearing more efficient?
- What kind of award do
you want? How can you efficiently enforce it?
