This panel will discuss the doctrine of “bankruptcy exceptionalism” and consider the doctrinal roots and durability of bankruptcy court powers, conflicting policy considerations in this debate, and implications for your practice and crafting arguments to obtain favorable rulings and sustain appellate review.
