Presented by the Estates and Probate, and Tax Law Sections
About the Program
This presentation examines the intersection of legal compliance, cybersecurity technology, and professional responsibility specifically for tax, estate and probate practitioners. This course satisfies Connecticut Ethics and New York Cybersecurity Ethics requirements by framing data security as an essential element of a lawyer's ethical duties. This seminar will analyze how fundamental cybersecurity ethics govern the management of highly sensitive personal and financial data. This session provides a clear roadmap to reconciling professional obligations, such as client confidentiality and supervision with modern regulatory demands, including the Connecticut Data Privacy Act (CTDPA) and financial privacy frameworks like GLBA and the FTC Safeguards Rule.
You Will Learn
- To evaluate how fundamental cybersecurity ethics underwrite specific Rules of Professional Conduct, including competence, confidentiality, communication, and the supervision of vendors and subordinates
- To analyze the ethical and regulatory boundaries between state privacy laws (such as evolving CTDPA mandates) and sector-specific financial frameworks like the GLBA and FTC Safeguards Rule
- How to implement risk management protocols, including data mapping, classification, and proportionate administrative, technical, and physical safeguards to protect sensitive client financial files and estate data
- How to manage third-party risk ethically by structuring vendor contracts with enforceable provisions for data deletion, confidentiality, and immediate incident notification to support the attorney’s duty of supervision
Who Should Attend
Estate, probate, and tax legal professionals seeking to align their ethical duties of confidentiality and vendor supervision with modern CTDPA, GLBA, and FTC cybersecurity mandates.
