Presented by the Estates and Probate, Tax, and Business Law Sections

About the Program

This presentation will discuss cybersecurity in relation to legal practice, and why it is our duty as lawyers to understand and execute adequate precautions to protect clients' information stored on our technological devices. We will first focus on the lawyer's duty as a fiduciary and exactly how this relates to the scope of this presentation. We will then discuss the relevance between cybersecurity competency and a lawyer's obligation to abide by the Connecticut Rules of Professional Conduct. Additionally, we will share both ABA formal opinions and state bar informal opinions regarding the use of technology in legal practice. Lastly, we will touch on some strategies for strengthening cybersecurity and data compliance in a legal setting.

You Will Learn

  • Why law firms and lawyers are prime targets for cyberattacks and data breaches
  • How the Connecticut Rules of Professional Conduct govern a lawyer's duty to protect client data and minimize the risks of cyberattacks
  • What other laws and regulations lawyers and firms must abide by with respect to data and cybersecurity
  • What specific cybersecurity measures are required to safeguard client data from hackers

Who Should Attend

Lawyers interested in learning about the ways in which rapidly developing technology can complicate an attorney's fiduciary and ethical obligations, and how to mitigate and prevent such complications through safeguards and thorough precautions.
