About the Program
In some bankruptcies, causes of action against directors and officers may constitute one of the most significant assets of the estate. These are often complex matters involving debtors, debtors’ directors and officers, insurers, and creditors or creditors’ committees. Discussion on this panel will include a refresher on the essentials of director and officer claims; the roles of various bankruptcy parties in interest in investigating and pursuing potential claims; perspectives of insurers and covered parties; and practical considerations in resolving claims, including through mediation and settlement.
