Presented by the Estates and Probate, and Tax Law Sections

About the Program

Estate planning is no longer one-size-fits-most as advances in social liberties, technology, and mobility continue to expand the concept of family. This presentation will discuss the ways in which inheritance rights for family have changed under the common law including the rights of spouses, adoptees, children born out of wedlock, children born through assistive reproductive technology, and LGBTQ family members. The presentation will also cover estate planning strategies for blended families, unmarried partners, and other chosen family.  Throughout, the panelists will discuss the challenges raised by mobility across states and internationally with respect to estate and inheritance laws and taxes, the treatment of trusts, and income taxation.

You Will Learn

  • About the implications and limitations of state laws on parentage and marital rights in estate and trust planning
  • About issue-spotting in cross-border estate planning and trust taxation with non-US citizen spouses, US citizens residing abroad, and non-US beneficiariesAbout estate planning strategies for unmarried partners, blended families, and chosen family
