About the Program
This panel will delve into the dynamic realm where litigation funding intersects with insolvency. Litigation financing allows trustees, debtors, and creditors’ committees to monetize and pursue valuable claims that otherwise may have to be abandoned or settled, thus increasing the potential for recovery for creditors. We will shed light on the opportunities, special challenges, and ethical considerations surrounding litigation funding in a bankruptcy case. The mechanics and funding terms for litigation funding will be explored, as well a typical funder’s underwriting process.

• About the potential uses of litigation funding in bankruptcy litigation, including whether such funding is practical for a particular case, and how to get such funding through the Bankruptcy Court
