About the Program

An overview of the Social Security programs of disability and retirement, focusing on eligibility for the benefits, ex-spousal eligibility for those benefits, and alienability of those benefits for the benefit of the spouse and children. The program will also address Social Security retirement, ex-spousal eligibility, valuation, and reduction of those benefits for the worker and ex-spouse by windfall elimination and government pension offset.

You Will Learn

  • The difference between the two disability programs of SSDI and SSI, and the effect of assets and income on each, in the setting of alimony, support, earning capacity, property division, and health insurance
  • What derivative benefits clients may be eligible for based on the disability and retirement benefit eligibility of their former spouses, and how those derivative benefits may be reduced or extinguished
  • When future Social Security retirement benefits should be considered as deferred compensation plan in assets and the anti-assignment provision of 42 U.S.C. § 407(a)
