About the Program
In November 2022, the Department of Justice, in coordination with the Department of Education, issued guidance for US Attorneys handling student loan litigation in bankruptcy cases. In this session, DOJ attorneys will discuss the core components of the guidance, including use of the IRS standards to determine a debtor’s standard of living and “presumptions” to evaluate a debtor’s future circumstances, and will review best practices for completing the attestation process. The panelists will also answer questions concerning the guidance’s implementation in student loan adversary proceedings.
