About the Program

What you don’t know can hurt you! Any attorney who serves clients insured under insurance policies–be they commercial clients or individuals - should understand insurance policy conditions. This program will interest anyone with clients insured under liability, professional and employment, property, and director and officer policies. The panel will address notice, cooperation, and other significant conditions to coverage as well as the rights and obligations of the insured policyholder and the insurance company under such policies. The panel will also address considerations when representing clients faced with a client’s possible breach of a condition.

You Will Learn

  • Important conditions to coverage under various insurance policies
  • The rights, obligations, and burdens of proof of each party to the insurance contract concerning the conditions
  • How to assess whether a condition to coverage has been satisfied or breached and what defenses or arguments may be asserted regarding coverage by the insured and insurer
  • Ethical considerations when representing clients confronted with whether a condition in the insurance policy has been satisfied or breached
