Presented by the Estates and Probate Section

About the Program

Recent statutory changes give parties the choice between probate court and superior court for most trust, estate, and fiduciary proceedings.  Significant procedural, substantive, and practical differences between the two forums make this choice a critical strategic decision, particularly in contested and complex matters.  This seminar guides lawyers on how to make this important decision by exploring both the legal and real-world differences between these two forums and how these major differences can be used to their advantage.

You Will Learn

About the allocation of jurisdiction between probate and superior courts in trust, estate, and fiduciary matters
About key differences in the organization, structure, procedures, and powers of each court
What factors practitioners should weigh when choosing whether to commence a proceeding in probate or superior court

Who Should Attend

Trust and estate lawyers who handle contested matters; litigators who handle trust, estate, and fiduciary disputes; and anyone interested in learning more about the differences between these two court systems.
