Program Description
Every now and then a lawsuit outlives one (or both) parties. What do you do as an attorney--either for the deceased or an opponent--to safeguard your client's interests? Does the particular claim survive the party's death under the survival statute? Who is your client (or your opponent) now, particularly if the party is an LLC, partnership, or other business entity? In our final program before the holidays, we offer a quick primer on these and other deathly topics. After reviewing the nuts and bolts of dealing with a death in the litigation, we briefly explore the relevant trial and appellate court authority on these issues.
