About the Program

Governor Lamont’s executive orders have created novel legal issues for workers’ compensation practitioners. Challenges to the validity of those orders, and the Commission’s implementation of them, are already here. This seminar is designed to assist practitioners in litigating specific controversies in this uncertain legal landscape.

You Will Learn

  • The history of executive orders in Connecticut, past challenges, the enabling statutes and their construction, constitutionality, legal arguments for and against the validity of the orders and the validity of agency actions based on them, and current cases challenging these orders in Connecticut
  • How the executive orders are affecting and may affect workers’ compensation practice, including the ramifications of legislative and/or Supreme Court ratification or invalidation
  • The history of the COVID-19 presumption, and the potential for ratification by the legislature, and whether ratification is likely to apply retroactively
  • About existing statutory presumptions, how they have been applied, and how that body of law may translate to COVID-19 presumption cases
  • Developments in other New England states regarding some of these issues
