Program Description

Transferring substantial wealth to children during retirement years is common in Medicaid planning. But certain kinds of transfers can ultimately prove costly for tax purposes. And the risks attending outright transfers to children, especially children who have problems with health, marriages, or creditors, can frustrate the client’s goal of providing security for children or even a spouse. Past section chair Mark Dost will explore the use of intentionally defective grantor trusts (IDGTs), which address a number of client concerns for effective Medicaid planning, tax planning, and transfer planning. And Uniform Law Commissioner and past Section chair Suzanne Brown Walsh will offer insights into the Connecticut Uniform Trust Code in connection with IDGT drafting.
