Preservation of the Estate Plan in the Face of Incapacity, Disruption and Avarice

Program Description

As lawyers, we strive to prepare estate plans that fulfill our clients’ testamentary objectives.  Typically, these plans are prepared when the client’s intent is clear and capacity is not at issue.  However, all too often, as our clients age and/or suffer cognitive decline, we see others seek to subvert these plans for their own benefit. What can we, as lawyers, ethically and responsibly do to protect our clients and preserve their estate plans. While there are no easy answers to this vexing question, we as lawyers are not without options.  Join us in an open discussion while we review some of the ethical, practical and strategic tools available to lawyers.
