Identifying a Potential Claim and How to Seek Civil Remedies

About the Program

Due to COVID-19 and limitations on visitation, families are now finding that without their oversight loved ones may not have been receiving necessary care. Negligent care has led to significant declines in their loved one’s physical and mental health or, in some instances, has even led to their loved one’s death. Nursing Home negligence cases can be complex and pursuing such a claim on behalf of a client can be a daunting task for many Elder Law attorneys. Elder Law attorneys can, however, assist by identifying potential claims and advising their clients how to seek civil remedies for the injuries suffered due to negligent care received in a nursing home.  Attorney Jeremy H. D’Amico with D’Amico & Pettinicchi, LLC, a plaintiff’s firm with a focus on nursing home neglect and abuse cases, will discuss how to identify a potential claim, how a settlement may affect an individual’s eligibility for Medicaid, steps that can be taken early on to preserve evidence, and how to assess the practicality of pursuing a claim.
