Program Description
On July 1, 2023, Connecticut became the 12th state to enact and implement the Uniform Commercial Real Estate Receivership Act – known as UCRERA. UCRERA provides a standardized framework for courts, receivers, and practitioners for the appointment of receivers in cases involving commercial real property and beyond. This program will focus on how the new law affects the procedures for appointment of receivers, the scope of the new law and the expanded powers and duties of Court-appointed receivers thereunder, and strategic considerations from drafting of loan documents to if, when and to what extent creditors should seek appointment of a receiver.
