CHRO Disparity Study and Implementation Bill

Program Description

In 2012, the Connecticut Academy of Science and Engineering released its analysis of the state's set-aside program, established under C.G.S. § 4a-60g, in which it concluded that the set-aside was set arbitrarily without statistical backup, that subcontractor data was not uniformly collected by the state agencies, and that the program was not designed as a narrowly tailored program. Thus, it concluded, the program did not meet the strict scrutiny judicial standard for justifying a race-based program and would not be upheld by any court if it were challenged. It recommended that the State conduct a disparity study based on quality data collection.

The Disparity Study was authorized by the State and begun as a partnering of CHRO and an outside law firm in July 2022. The Disparity Study was released in December 2024, and its recommendations are contained in a newly-introduced bill, Raised Bill 1518, before the Connecticut Legislature. The bill makes broad revisions to the state’s set-aside program including changing the statutorily-set percentage of set-aside goal of 25 percent to project-specific goals, authorizing CHRO to establish project-specific set-aside goals based on MWBE participation data, and on CM projects, requiring first-tier contractors to submit a set-aside plan with CHRO, which has 120 days to review and approve it.

The Construction Section Program will host speakers CCIA President Don Shubert and John Sullivan, Esq. to discuss the Disparity Study and the proposed implementation measures. John Sullivan is a Baltimore lawyer who specializes in DBE and MWBE disparity studies.
