Credibility Considerations for Jury Selection

Program Description

Do you find yourself relying on credibility assessments in your practice? Whether selecting jurors, deposing a witness, or interviewing one’s own client, much of what we do comes down to a gut feeling about whether someone’s telling us the truth. Professor Julia Simon-Kerr of the University of Connecticut School of Law studies credibility and the assumptions that often underlie credibility assessments in the legal system. On June 10th, 2025, Professor Simon-Kerr will discuss with the Section the history of credibility assessments in law; how demeanor can and should impact these assessments; and what we can do, as practitioners, to best assess the strangers who show up in a venire pool as potential jurors. Professor Simon-Kerr’s research on the law and lying will help litigators better pick a jury, and in nearly all aspects of the litigation process.
