Program Description

This presentation will start with the basics of modifying, decanting and merger, then proceed to evaluate how these different techniques apply in the context of special needs trusts, both first party and third party. The good news is that we have a number of new tools available, but special needs trusts present unique considerations. Not all techniques are suitable for all cases; there are limitations on what is permissible, but there are also valuable new opportunities.
