About the Program

This seminar helps legal professionals in the workers' compensation field navigate complex cross over issues. The day begins with a comprehensive fact pattern followed by a breakdown of overlapping rules from the ADA, FMLA, OSHA, ERISA and state-specific acts like the Connecticut Paid Family and Medical Leave (CTPFMLA) and CFEPA. Sessions also address transitional duty obligations and alternative return-to-work solutions, closing with an interactive panel review of the opening hypothetical.

• About critical factors your clients need to know in the analysis of the intersection of federal and state FMLA and other leave laws
• About the key operations of the Connecticut Paid Leave Authority, including benefit distribution, employer contribution collection, and private plan oversight
• How to analyze undue hardship, and documentation requirements under the ADA and CFEPA when a workplace injury triggers independent disability accommodation obligations
• How to evaluate return-to-work and transitional assignment obligations under Connecticut General Statutes §§ 31-313 and 31-308(a)
• How Enlyte’s program uses non-profit community placements to manage return-to-work outcomes when onsite accommodation is unavailable
