Program Description
Arbitration has promised that it is faster, cheaper, and more efficient than litigation. However, it often fails to fulfil those goals, leaving attorneys and their clients dissatisfied with the process. In this program, three arbitrators from different backgrounds will discuss how a “litigation mindset” interferes with the arbitration process.
In a question-and-answer format, the panel will discuss issues like:
Is arbitration worth the trade-offs?
- What should a well-drafted arbitration clause address?
- Can arbitration effectively resolve injunctions and non-monetary relief?
- How does discovery differ in arbitration and litigation?
- Are there opportunities that arbitration’s flexibility presents for imaginative counsel?
