Update on the Law of Surety Bad Faith

Program Description

In August 2023, the Connecticut Appellate Court in Colonial Surety Company v. Barbara, addressed and refined the legal standards under Connecticut common law for claims of bad faith against construction bond sureties arising out of the settlement of bond claims. This was the first significant decision by either the Connecticut Appellate Court or Supreme Court on the topic of surety bad faith settlement of construction bond claims since the Connecticut Supreme Court’s 2004 decision in PSE Consulting, Inc. v. Frank Mercede and Sons, Inc. This program will feature a discussion of Connecticut’s common law applicable to surety bad faith claims in light of the recent decision in Colonial Surety Company v. Barbara.
