About the Program

This CLE will address different forms of discovery that one may encounter in a family law matter that fall outside of a “normal” mandatory discovery request. The speakers will review the new laws on interstate discovery, how to appropriately handle out of state depositions, including when and where to file a commission to take an out of state deposition, and how to properly serve subpoenas of both third parties and financial institutions, such as banks. The speakers will address the applicable Practice Book Sections, statutes, time periods and limitations, along with any case law that the attendees should be aware of, which will include discussion on implementation of the Interstate Deposition and Discovery Act.

You Will Learn

How to properly approach discovery, thinking outside of the box, including:
o identifying those discovery issues outside of those most frequently encountered
o steps on how to collect the discovery
o how to properly authenticate and submit / preserve the testimony and documents for the Court

Who Should Attend

Anyone interested in learning proper techniques to discovery inquiries, and those who want to brush up on the proper procedure for depositions and discovery.

About the Program

This session will teach attendees how to properly manage their custody case, which may be either dissolution, custody, or post judgment, if they do not have a custody evaluation, a Guardian ad Litem, or other expert investigation, when so many typically rely heavily on these types of input in their presentation to the court. This session will navigate through the preparation and hearing process when the parties may not be able to afford a private custody evaluation, a Guardian ad Litem, or other independent evaluation and how to work around it. The presenters will discuss how to properly prepare and present your custody case through the witnesses and exhibits that you have available to you and how to properly work through the custody presentation.

About the Program

This seminar will focus on other areas of the law that may come into play in your dissolution action and how to properly prepare for them and avoid potential malpractice. The areas that will be addressed in this CLE will be: Trusts and Estate, Criminal Law, Tax Issues, and Bankruptcy.

It is important for practitioners to easily identify when an outside issue arises and how to appropriately handle it. Many times, practitioners do not understand other areas of the law and how they could in fact impact a family law order or agreement. We will have practitioners from other areas of the law to discuss how best to handle a situation that may arise and when to bring in outside counsel, as an expert, to consult with, or for representation in a separate proceeding.
