Capacity, Ethics, and the Courts

Program Description

This presentation will address capacity, including ethical matters as well as tools and practical tips for attorneys when working with clients whose capacity is waning. The program will include discussion regarding the difficult problem of undue influence on vulnerable individuals, and how some modern estate planning options can facilitate this problem and how it may be combatted. The attendees will learn about conservatorships, both voluntary and involuntary, the hearing process, evidentiary requirements, and issues which often arise, including end of life decisions. This portion of the presentation will include a discussion of probate courts and their determinations capacity or lack thereof, alternatives to conservatorships, and choice of a conservator. Finally, the presentation will address recent intriguing issues raised by the Connecticut Supreme Court regarding the ability of people under a conservatorship to make estate planning decisions as well as the limits of conservator’s authority.
