U.S. v. Patel:
Trying a Criminal Antitrust No-Poach Case

Program Description

Attorney Spears recently represented a defendant in the case-captioned United States v. Mahesh Patel, et al., a criminal antitrust case brought in the District of Connecticut by the Antitrust Division of the U.S. Department of Justice and the United States Attorney’s Office.  On April 28, 2023, after weeks of trial, United States District Judge Victor A. Bolden entered a judgment of acquittal for all defendants. Attorney Spears will discuss some of the highlights of the case, including pretrial motion practice, the use of experts, evidentiary issues, trial strategy and the nature of Judge Bolden’s ruling in favor of the defendants.  Attorney Spears will also discuss his views on the future of the DOJ’s prosecution of no poach agreements and market allocation agreements.
