Credit Card Surcharges and Cash Discounts: Update on Recent Litigation

This article reviews the impact of recent First Amendment challenges to state statutes prohibiting credit card surcharges, and other regulatory compliance issues that arise if sellers (including lawyers) surcharge customers who pay by credit card.
Out From under the Brick—A Long Road to a “New” Antitrust Remedy for Connecticut Consumers

After four decades, Connecticut has fully joined the majority of states that allow consumer antitrust claims by, or in the name of, “indirect purchasers.” Allowing claims for damages on behalf of “indirect purchasers” means that the state’s consumers and others may obtain antitrust recoveries against defendants even though a defendant did not deal directly with the person on whose behalf the action is brought.
